Computer Rental Agreement

When renting a computer, one must agree to the Computer Rental Agreement at the time of rental, however, a signature is not required.

Terms of Rental Service Agreement

This Rental Agreement Terms of Service Agreement (”Agreement”) represents an agreement between the Party to Bill (“You/Your”) and Brigham Young University and its Office of Information Technology (collectively “OIT”).

  1. This Agreement is executed for the purpose of providing hardware and associated software that has been made available by BYU for educational purposes (“Rental Equipment”). This is a monthly rental agreement and shall not in any wise be construed as a rent-to-own agreement.
  2. In order to participate in the rental program, You must be an current Student, Faculty Member, or Employee of BYU. OIT cannot communicate with any individual other than You regarding the Rental Equipment or this Agreement.
  3. This Agreement becomes effective upon Your receipt of Rental Equipment.
  4. OIT will not deliver or pick-up Rental Equipment. It is Your responsibility to transport the Rental Equipment to the OIT location for repairs or returns. Returns are only accepted at OIT’s location or at authorized trailers. Trailers are only available at the beginning of Fall semester and at the end of Winter Semester.
  5. Rental Equipment shall not be used for commercial purposes.
  6. The monthly charge for Rental Equipment will be assessed monthly to Your My Financial Center account based on the latest published Rental Fee structure. A one-month minimum charge will be assessed regardless of the duration of the rental. Charges will be assessed on the first day of the month for the previous month’s rental. Upon termination of this Agreement, and after the first month, charges will be pro-rated to the day. Pricing may be adjusted annually.
  7. You assume full responsibility for safeguarding the security of the Rental Equipment. If the Rental Equipment is damaged, lost, or stolen, a charge equal to the value of the Rental Equipment or cost of repairs to the Rental Equipment will be charged to Your My Financial Center account.
  8. If You have placed software or in any way locked the Rental Equipment so as to make it unusable, the Rental Equipment will be designated as damaged and a charge equal to the value of the Rental Equipment will be charged to Your My Financial Center account.
  9. You are prohibited from opening the Rental Equipment or installing personal hardware (i.e. RAM, soundcard, hard drive, CD-ROM) for any reason. You shall not alter the physical appearance of the Rental Equipment.
  10. Maintenance and repairs on Rental Equipment shall only be performed by OIT. Any required or requested repairs must occur at OIT by OIT-authorized personnel or an OIT-authorized third party. Service issues must be reported to OIT within 7 days. Credits to Rental Fee due to maintenance and repair requirements will be authorized at the sole discretion of OIT.
  11. OIT will support OIT-installed software free of charge. The available OIT-installed software may be subject to change. Software installed by You or any person or entity other than OIT on the Rental Equipment is Your responsibility. You are responsible to ensure that all software used on the Rental Equipment meets all legal requirements for licensing from the software manufacturer. Any OIT assistance with user-installed software may be assessed a $25 fee.
  12. Neither OIT nor BYU is responsible for any loss of data. You are fully responsible for any data stored on the Rental Equipment. It is recommended that You back up Your data regularly (e.g. BYU box, Google Drive, an external HDD, etc.).
  13. You shall abide by BYU's Honor Code when using Your Rental Equipment. Discovery of failure to abide by the Honor Code will result in Your referral to the Honor Code Office and possible confiscation of the Rental Equipment.
  14. OIT has no obligation for Rental Equipment compatibility with user-owned or user-installed peripherals (printers, scanners, etc). There will be a $25 charge to assist with installing peripherals.
  15. In the event that functionally-superior Rental Equipment becomes available, Rental Equipment may be exchanged for functionally-superior Rental Equipment at any time for a $25 exchange fee.
  16. Rental Equipment must be returned to OIT when Your Student, Faculty, or Employee status is no longer active.
  17. OIT reserves the right to require the return of Rental Equipment at any time. OIT must provide You a two-week advance notice of a mandatory return of the Rental Equipment.
  18. Rental Equipment not returned to OIT upon termination of active status will result in a $50 non-refundable fee being charged to Your My Financial Center account. In addition, a $1000 assessment will be charged to Your My Financial Center account to cover loss of hardware and software and recovery services, which charge will be removed upon OIT-accepted return of the Rental Equipment.
  19. You agree that if all charges You incur are not paid by the due date and if, for the purposes of collecting the amount due, BYU should retain an attorney or collection agency, You will pay all costs of collection including reasonable interest, reasonable attorney's fees, and reasonable collection agency fees, which may be based on a percentage at a maximum of 40% of the debt.
  20. You also agree to allow BYU or its agent to contact You by email or cell phone in an effort to collect the debt. You also authorize BYU or its agent to use automated telephone dialing equipment, and to use artificial or pre-recorded voice messages in their efforts to contact You. Further You understand that You may withdraw Your consent for BYU or its agent to use automated telephone dialing equipment or artificial or pre-recorded voice messages to contact You by submitting Your request to the BYU Collections Office via YMessage or in writing or verbally at A-153 ASB, Provo, UT 84602; (801) 422-6634 or verbally or in writing to the applicable agent contacting You on behalf of BYU. Finally,You understand that Your delinquent account may be reported to one or more of the national credit reporting agencies.
  21. OIT reserves the right to refuse service.
  22. This Agreement represents the entire agreement for Rental Equipment between You and OIT.
